DOWNLOADING & USING THE BUYSECURE ® SERVICE, THE USER RECOGNIZES AND ACCEPTS THE FOLLOWING TERMS & CONDITIONS AND THE TREATMENT OF PERSONAL INFORMATION – PRIVACY.
If the user does not accept anyone of the following terms and conditions, he/she will not be able to use the buySecure® system.
1. Acceptance
This is an agreement between 3C System s.r.l. (3C System), a company under Italian law, owner and manager of APP software buySecure ® (buySecure ® service) downloadable from Google Play, I-tunes and Windows and the user which utilizes this APP software service. Using the buySecure ®, the user recognizes and accepts the terms of the same and the treatment of personal information that can be found at the following link http://www.3csystem.com/APPprivacy.html. If the user is not in agreement with anyone of these conditions, he/she cannot use the service.

2. Terms and Conditions for the use of buySecure® services

The present Terms of Use are applied to all the users of the buySecure ® service. The information supplied to our users through the buySecure ® service can contain connections to third party portals and/or information inserted by third parties that is not the property or controlled by 3C System. 3C System does not have control, and it cannot assume any liability, for content, for the treatment of personal information, or the practices applied on any third party portals. As well 3C System does not have the option of censuring or modifying the contents of any third party web sites. Using this service, the user expressly recognizing and accepts that 3C System is not responsible for eventual damages or demands nor does it assume any other responsibility deriving or connected to the use of any third party portal and/or contents inserted by third parties. The user takes note that 3C System has the option to allow third parties to absolve on its behalf all obligations provided for in the present agreement. As well the user accepts that 3C System can transfer its rights or obligations provided for by the present terms to a third party. In the event that rights and obligations belonging to 3C System should be transferred to a third party, the user shall receive notice. The user takes note that 3C System can send notifications by email, SMS or push notifications.

3. Access to buySecure ®

Conformant to the Terms of Use, 3C System grants authorization to the use of its own service buySecure ® on condition that: (i) the use of the service buySecure ®, as allowed, takes place exclusively for personal use, and there is no option of transfer to third parties or forcing third parties to pay for the use or access to the service, and the use of any other incompatible form with the Present Terms of Use shall be prohibited; (ii) no duplication, transfer, consent for service use, no copies or distribution of any part of the buysecure ® system is allowed in whatever form without prior written authorization given by 3C System; (iii) there is no attempt to recodify, alter or modify any part of the buysecure® service; and (iv) that in any case the terms and conditions present in the Terms of Use and Treatment of Personal Information are respected.
In order to access the buySecure® service and use its functions, the user expressly recognizes and accepts that it shall have to supply his own cellular phone number to 3C System. The use expressly recognizes and accepts that in order for 3C System to supply the buySecure® service, 3C System, through the buysecure® system, can periodically access a list of contacts and/or agenda present on the mobile phone of the user in order to reach and keep a trace of phone numbers of the other users of the service. By supplying his phone number, the user is obligated to supply true, accurate and complete information. With the present agreement the user gives his consent to 3C System to access the list of contacts and/or agenda containing phone numbers of cellular in order to allow the supply and use of the service. 3C System does not archive names, addresses or email address, but only a list of mobile phone numbers. The user has sole liability for the messages that are supplied and that are viewed on its own phone number in relation to the buySecure® service. It is important to immediately advise 3C System of any violation of safety norms or any use that is not authorized on its own phone number. Even if 3C System cannot be considered liable for the losses caused by the non authorized use of the users account, that can be considered responsible for losses or damages incurred by 3C System or by third parties in consequence of such unauthorized use.
The user undertakes to not use or launch any automated system, that is capable of accessing the buySecure® service in such a way to send request messages to 3C System servers in a specific time period, and that can reasonably be produced in the same period, using the application buySecure®; the user takes note that it is prohibited to reproduce the contents unless prior authorization is given. 3C System shall not tolerate any steps to recodify its own system, or its protocols, or rather to carry out investigations that are external to limits that are normally made by buySecure® system users. 3C System shall refuse in all manners possible the requests to modify or any other activities that have the purpose to carry out investigations or to damage penetrate or test software systems. The user has the obligation to protect buySecure® services before starting measurements, functioning assessments or any other form of monitoring of any network equipment, server or instruments that host buySecure® services. The user accepts to not gather or save information for personal identification from buySecure® services, inclusive of telephone numbers, for the purpose of notices and marketing spam, as well as for communication systems services supplied by the service. The user cannot send spam or marketing messages to any buysecure® service users.

4. Intellectual Property Rights
The design of buySecure® services with buySecure® text created, scripted, graphically designed, sound effects, interactive functions and similar- with exception of eventual status transmissions (point 6) – and trademarks, commercial trademarks or logos (“Trademarks”), belonging to 3C System or licensed to 3C System; they are subject to the copyright norms and to other intellectual property rights within the realm of the Law and all international agreements on the subject. BuySecure® services are supplied to the user in the state that they are found, for informative purposes and for personal use. 3C System reserves all the rights not expressly granted by buySecure® services and to the buySecure® service. The user accepts to not undertake to use, to copy or distribute any part of the buySecure® service that is not expressly granted in the present agreement, inclusive of any use, copy or distribution for commercial use regarding transmission status to third parties obtained through the buySecure® service.

5. Data gathering, information, messaging and notifications
During use by the user of buySecure® services or the viewing of contents supplied through buySecure® services, 3C System automatically gathers and memorizes, in its server log and also on the mobile device, methods of use, data and information (including personal information), also using mechanisms such as web archiving through a browser (including HTML 5) and databases, to offer better services. In particular:

After having downloaded APP, the buySecure® system requests that the user inserts his own phone number for identity verification by sending a password via sms (this data is not disclosed)
Pictures, email, date of birth, sex, etc. (insertion is optional and the data is non disclosed)
Every interrogation done on the buySecure® done by the user, including reading localization through GPS of the user’s mobile device. When a user uses the buySecure® service, with position localizer that is active on the mobile device, we can gather and elaborate information received on the current active position, using both the GPS signal sent as well as other technology to establish position, such as, for example, sensor data from the device that can disclose information on WI-FI access points and on mobile signal network towers in the vicinity.
Information regarding product searched and identified by the user with buySecure® codes.
Specific information on the device (for example hardware model, operative system version, unique identifiers for the mobile device, the language used and information on the mobile network, including the telephone number). 3C System can associate the device identifiers or the user’s telephone number to his buySecure® account.

3C System uses the information acquired on its services to offer, manage, protect and improve them, to develop new services and to protect buySecure® and its users. The buySecure® service uses the data through cookies and other technology, such as tags and pixels, to improve the user’s experience as well as the general quality of its services. Just as an example, if a user saves his language preference, the buySecure® service can be visualized in the language preferred by the user. If the user can view specific marketing communication, it will not be associated to a cookie or an anonymous identifier for sensitive categories such as race, religion, sexual orientation or health.
The buySecure® APP has an integrated messaging system that permits sending and receiving text messages and file sharing, such as images, videos, audio, vCards and positions. The messaging section can show: (i) that the user and user’s contacts are active or when they have been active the last time; (ii) who is writing and when a message has been sent, delivered and read. Group Chat only works with enabled contacts. The user is responsible for his messages and must therefore insure that they are conformant to all applicable laws and regulations. In particular, the user must insure that his messages are not damaging, offensive, contrary to the law, obscene, defamatory, blasphemous, racist or constitute a violation of intellectual property rights, moral rights, copyright or protection of personal information rights of third parties nor publication rights.
The buySecure® service also permits sending push notifications. In particular:

Automatic sending of push notifications directly by the buySecure® system to users:

To request a second interrogation on buySecure® codes
In the case of recall or robbery of certain goods
To notify certain important aspects in relation to the life cycle of purchased products.

Sending push notifications (promotional messages, for example) by 3C System clients (production companies of the articles identified by buySecure® codes) to users of the service, but only in the case that at least one buySecure® code of a product has been read at least 2 times and if the product has presumably been acquired by the user. 3C System clients are not aware of the phone number and of the other user data (the single buySecure® code of the product acquired and localization of the code readings are the sole information supplied to 3C System clients). 3C System cannot be deemed responsible for the contents in messages and notifications in relation to products (only 3C System clients shall be liable). The missed insertion of such data does not compromise the use of the buySecure® APP.

6. Status Transmission (communication concerning the status of the user, his profile, pictures or other communications of a personal nature)

The buySecure® services permits its users to transmit a status text, a profile picture and other communications to the user, such as automatic transmission of status such as “seen the last time” (in general, “status transmission”). These status transmissions can be received, shared and/or published as part of the buySecure® service, and can be visible to other users of the service that have the mobile phone number of the user on their mobile that has not been specifically blocked. It should be noted that directed messages, localization data, pictures or files sent directly to other buySecure® users shall be visible only to buySecure® users or groups that such information is directly transmitted to; but the status transmissions can be visible on a global level by buySecure® service users that have the mobile phone number of the sender in their smartphone, unless said user of buySecure® services is not blocked by the sender himself. At the moment the system does not allow the supply at different levels of visibility for status transmissions amongst users that have the telephone number of the sender. To this end the buySecure® service user accepts and takes note that any contribution of status can be visualized at a global level by all the users who have the mobile phone number of the sender. The user accepts that it is advisable to not send or post status or profile messages or pictures that they do not want to render visible on a global level. It is therefore good custom to avoid sending status transmissions to the service if there is not desire that the entire world sees them or that they can see them in a partial manner. The transmission of one’s own status such as “last seen” is done on an automatic basis. As made clear in the previous section, the user fully maintains his property rights on his status transmissions. The user accepts that once such contributions are made public, 3C System can no longer guarantee privacy with reference to any document or image or other.
The user is solely responsible for his status transmissions and for the consequences deriving from their publication. In consideration of the fact that 3C System acts only as a data saver, status transmissions and contents inserted by the user do not necessarily represent the opinions of 3C System, and 3C System does not offer any guarantee on their validity, accuracy or legal status. In relation to status transmissions, the user recognizes, guarantees and accepts that: (i) the user himself is the owner and disposes of the necessary licenses, rights, consent and authorizations for the use and to authorize 3C System to use such copyrights, trademarks, commercial secrets, intellectual property and other property rights in relation to status transmissions of any type in order to allow the insertion and use of the status transmissions in a manner provided for by the service and the present conditions; and (ii) to have written consent, exoneration, and/or authorization of each single person identifiable in the status transmission to use his own name or image in such a manner as to allow the inclusion and use of status transmissions that are conformant with to the service and its conditions. In other words, the user maintains all the property rights on his status transmissions, but on condition that the user himself can dispose of such rights. Therefore, by sending status transmissions 3C System is given a worldwide license, that is not exclusive, with the faculty to sub-license and transfer, for the use, reproductions, distribution, derive works, visualize and execute status transmissions with the buySecure® service and the activity of 3C System (and those having right), inclusive, without limitation, the promotion and redistribution of one part or all of buySecure® services (and derived programs) in any format or through any channel. Furthermore the user allows, to anyone who has access to his status on the buySecure® service, a non-exclusive license to access status transmissions through the service. The license given by the user ends once a status transmission has been eliminated or removed from the buySecure® service.
In relation to status transmissions, the user accepts and agrees that he shall not: (i) send material that is protected by copyright, protected by commercial secrecy or that such property rights, inclusive of privacy and publicity rights belong to third parties, unless the user himself is not the legitimate owner or has not received authorization by the legitimate owner to publish the material and give 3C System all the licensing rights necessary; (ii) publish false information or false declarations that can be damaging to 3C System or third parties; (iii) render public material that is illegal, obscene, defamatory, menacing, insulting, offensive hateful, racist or ethically offensive, and that can induce someone to carry out counterfeit deeds or rather entertain behavior that can be considered a crime or create civil liability; (iv) publish marketing or invites to sign commercial agreements; (v) replace another person; (vi) send or archive material containing viruses, worms, Trojans, or other codes, files, script or programs that are damaging; (vii) try to obtain unauthorized access to the buySecure® service or to its operative systems or connected networks.
The material, which is directed to adults, must be identified as such and relevant publication of status transmission or opinions, recommendations or advice expressed, is done without prior authorization by 3C System. 3C System expressly declines any responsibility in relation to the transmission of such statuses. 3C System does not give any form of authorization for activities that by, using its buySecure® service can constitute a violation of copyright and/or violation of intellectual property rights, and 3C System shall remove all publications of content and statuses, if they are correctly informed that the content or status published can violate intellectual property rights. In order to correctly notify on a copyright violation, the interested party must send written communication that substantially includes the following: (i) a signed document (both in hardcopy, as in digital format) from an authorized subject that intends to act in the name of and on behalf of the owner of exclusive rights that are violated; (ii) identification of works protected by copyright that are violated, or rather, in the case that a complaint is made with a single notification of such violation on more than one work protected by copyright, such as a complete representation of said works; (iii) identification of material that is considered violated or is the subject of illicit activity or that it must be removed or that access must be disabled, as well as all the reasonably sufficient information that allows 3C System to identify the material, including the phone number of the user, that we assume is violating copyright; (iv) sufficient information to allow 3C System to contact the party that sends notification, such as for example, by address, telephone number and, if available, email address where the defaulting party can be contacted; (v) a declaration by the defaulting party has valid and reasonable motives to confirm the complained use on the material that has not been authorized by the owner of copyright, or by his representative, or by the law; and (vi) a declaration that the information contained in the notifications have been accurately verified and, under the threat of false testimony, that the damaged party is authorized to act in the name and on behalf of the owner of exclusive rights that are considered violated. Such written notices can be sent via email to info@3csystem.com. 3C System reserves the right to remove without notice content and status transmissions that are published. 3C System can also suspend access of a user to the system in the case that 3C System has matured the conviction that they are dealing with a repeat offender, and that due to the fact the user, due to unilateral decision by 3C System, has caused disturbance. The user that has been contested many times is considered a repeat offender for illicit acts and/or status transmissions that have been removed from the service more that two times. A disturbing person is he who is determined (even due to only a whim) to undertake behavior, which is disturbing to 3C System, or rather its employees, agents, or authorized representatives. 3C System also reserves the right to decide if the contents or status transmissions are appropriate or conformant to the present Terms of Use for buySecure® even in the cases of infractions that are different from copyright violations or violations of intellectual property rights, and more in general as an example such contents or status transmissions are excessively long or have scares general interest. 3C System also reserves the right to remove status transmissions and/or terminate access by a user for the upload of materials in violation of the present Terms of Use in any moment, without prior notice and under its sole discretion.
The user undertakes that, with the use buySecure® services, he can be exposed to status transmissions from an undisclosed number of sources and that 3C System is not responsible for accuracy, utility, safety or existence of intellectual property rights or similar in relation to status transmissions and that they are not the competence of 3C System. As well the user recognizes and accepts that he can be exposed to status transmissions that are imprecise, offensive, indecent or questionable, and accepts to renounce, as is with the present acceptance, to any claims in any form against 3C System in consequence of what follows, accepting to release from liability 3C System, its shareholders, workers, directors, employees, agents, affiliates, representatives and/or licensees, in the limits allowed by law, from any complaint that can come up in relation to the use of the buySecure® service.
3C System allows the connection of materials to its service only for personal use. 3C System reserves the right to suspend in any moment and without prior consent any characteristic or property of the buySecure® service.

7. Exclusion of Guarantee and Liability limits

THE USER ACCEPTS THAT THE USE OF BUYSECURE® SERVICES SHALL BE AT HIS RISK AND DANGER, IN THE MAXIMUM MEASURE ALLOWED FOR BY LAW. 3C SYSTEM (INCLUSIVE OF ITS SHAREHOLDERS, WORKERS, DIRECTORS, EMPLOYEES AND AGENTS) DECLINES ANY RESPONSIBILITY, EXPLICIT OR IMPLICIT, AND IN RELATION TO THE SERVICE AND THE USE OF THE SAME. 3C SYSTEM DOES NOT GRANT GUARANTEES OR DECLARATIONS ON THE ACCURACY OR COMPLETENESS OF ITS CONTENTS OR THE FUNCTIONING OF ITS SERVICE AND DOES NOT UNDERTAKE ANY RESPONSIBILITY FOR ANY: (I) ERROR OR IMPRECISION OF CONTENT, (II) PERSONAL DAMAGES OF ANY NATURE, CONSEQUENT TO ACCESS OR USE OF THIS SERVICE, (III) NO AUTHORIZED ACCESS OR USE OF SERVERS AND/OR ALL PERSONAL AND/OR FINANCIAL INFORMATION THAT IS MEMORIZED WITHIN, (IV) BUGS, VIRUSES, TROJANS OR SIMILAR CODES THAT CAN BE TRANSMITTED THROUGH THE PRESENT SERVICE ON INITIATIVE OF THIRD PARTIES, AND/OR (V) EVENTUAL ERRORS OR OMISSIONS IN CONTENT OR FOR LOSS OR DAMAGE OF ANY TYPE CAUSED BY THE USE OF ANY PUBLISHED CONTENT, TRANSMITTED OR OTHERWISE RENDERED AVAILABLE THROUGH THE BUYSECURE® SERIVCE. 3C SYSTEM DOES NOT GUARANTEE, NOR APPROVE, NOR ASSUMES RESPONSIBILITY FOR PRODUCTS OR SERVICES PUBLISHED OR OFFERED BY THIRD PARTIES THROUGH THE BUYSECURE® SERVICE OR THROUGH ANY PORTAL CONNECTED OR HIGHLIGHTED TO ANY MEANS OF THE USER OR ANY PUBLICITY. 3C SYSTEM CANNOT BE INVOLVED OR DEEMED IN ANY WAY LIABLE FOR MONITORING OF TRANSACTIONS BETWEEN THE USER AND THIRD SUPPLIERS OF PRODUCTS AND SERVICES. AS WHAT USUALLY TAKES PLACE WITH THE PURCHASE OF A PRODUCT OR A SERVICE IN WHICH ANY MEANS IS USED OR AT ANY SUPPLIER, IT IS ADVISABLE TO ADOPT THE BEST FORM OF ATTENTION AND CAUTION. THE LIMITATION OF LIABILITY IS APPLIED IN THE MAXIMUM MEASURE ALLOWED BY LAE. THE USER RECOGNIZES THAT 3C SYSTEM SHALL NOT BE LIABLE FOR BEHAVIOR BY THIRD PARTY USERS THAT HAVE DEFAMATORY, OFFENSIVE OR ILLICIT CHARACTERISTICS AND THAT RISK DAMAGES OR RATHER DAMAGES DERIVING FROM SUCH BEHAVIOR SHALL FALL SOLELY ON THE USER.
THE BUYSECURE® SERVICE IS CONTROLLED AND OFFERED BY 3C SYSTEM THROUGH, IT’S SERVERS LOCATED IN ITALY. THOSE WHO INTEND TO ACCESS OR USE BUYSECURE® SERVICE IN OTHER AREAS SHALL DO SO BY CHOICE AND SHALL BE LIABLE IN CONFORMITY TO LOCAL LAWS.

8. Indemnity

The user accepts to protect, release from liability and indemnify 3C System, its shareholders, workers, directors, employees and agents, from and against any responsibility claim, damages, obligations, losses, responsibility, costs or debts and expenses (inclusive of legal expenses) deriving from: (i) use and access of the buySecure® service; (ii) violation of any clause in these Terms and Conditions for Use; (iii) violation of third party rights, including, without limitation to, intellectual property rights, property rights and privacy rights; and (iv) any other activity from the user that causes damages to third parties. Such obligations to defend and pay out shall remain valid and efficient even at the duration of the present Terms and Conditions of Use and the use of Buysecure® services.

9. Capability to accept Terms and Conditions of Use

The user expressly acknowledges that he is over 18 years of age and has full capacity to undertake the terms, conditions, obligations, declarations, affirmations and guarantees provided for in the present Terms of Use, and that he will follow and respect such terms. In any case the user acknowledges to be eighteen years of age or older, and that the use of buySecure® services is not indicated for minors. If the user is under eighteen years old, he does not have the faculty of using buySecure® services. The user declares and guarantees that he does not live in a country which is under commercial blockage or sanctions by Italy or the EU, or that it has been indicated by Italy or the EU as a country supporting terrorism, or that the user declares that he is not in a condition that limits his capacity to act. 3C SYSTEM is the company that owns the services, with domicile in loc. 10. Transfer
The present Terms and Conditions of Use, as well as rights and licenses granted with the present document, cannot be transferred or assigned to third parties by the user, however 3C System has the right to transfer or dispose of them without any restrictions.

11. General Conditions
The user accepts that: (i) the buySecure® service does not directly involve 3C System, both in general and in particular cases, in jurisdictions outside of Italy; and (ii) the user accepts to be under Italian jurisdiction for any legal controversy. Italian Law disciplines the present Terms of Use. Any claim or controversy between the user and 3C System, deriving fully or in part from the buysecure® service shall be decided exclusively by the Court of Cassino (FR) in Italy. The present Terms and Conditions of Use, together with the Treatment of Personal Data and all further legal notices published by 3C System, constitute the entire agreement between the user and 3C System in relation to the use of buySecure® services. If a competent court deems any clause in these Terms and Conditions of Use not valid, the invalidity of such clause shall not undermine the validity of the remaining clauses in these Terms and Conditions of Use that shall remain valid to all effects. No rejection of any of the clauses contained in these Terms and Conditions of Use shall be considered a formal rejection of such clause or any other, and in the event that 3C System omits making do o such rights or clauses contained in the present general conditions of use this fact does not constitute a rejection of such right or clause. 3C System reserves the right to modify or correct the present Terms of Use in any moment, and it shall have the right to review the Terms and Conditions of Use for further changes. The non-acceptance of the new Terms and Conditions of Use shall result in suspension of buySecure® services. The use of buySecure® services, followed by any modification of the Terms and Conditions of Use, shall automatically imply the acceptance to the modified terms. THE USER AND 3C SYSTEM CONVENE THAT ANY ACTION DERIVING FROM THE USE OF BUYSECURE® SHALL BEGIN WITHIN (1) ONE YEAR FOLLOWING THE FACULTY TO ACT. FOLLOWING ONE YEAR AND IN THE ABSENCE OF EXECUTION OF ACTION, THE RIGHTS ARE CONSIDERED EXTINCT.

TREATMENT OF PERSONAL INFORMATION - PRIVACY

As per the Legislative Decree n.196 from the 30th of June 2003 by the Italian Republic (“Code on the subject of personal information protection”), the treatment of personal information shall be treated based on the principles of correctness, transparency and protection of privacy and the rights of the user.

As per article 23 of the Legislative Decree n.196/2003 from the Italian Republic and in relation to personal information that they will receive, the following is observed:

1. USE OF TREATMENT
The treatment of personal data supplied by the user is finalized solely for the correct and complete execution of the service requested.

2. TREATMENT METHOD
The treatment shall be carried out in digital format.

3. OPTIONAL NATURE OF DATA TRANSFER AND THE CONSEQUENCES OF AN EVENTUAL REFUSAL TO RESPOND
Data transfer is optional therefore the eventual refusal to supply information can result in the partial execution of services.

4. COMUNICATION AND DIFFUSION

Those mandated for the treatment of information can become aware of personal information of the user. Personal information shall not be communicated to other subjects; the gathering, archiving and elaboration for eventual accounting administrative needs shall not be subject to diffusion.

5. IDENTIFACTION DATA OF THE OWNER, RESPONSABILE OR REPRESENTATIVE OF THE OWNER ON THE TERRITORY.

6. RIGHTS OF THE INTERESTED PARTY
In any moment the user can exercise his rights towards the person mandated, as per article 7 of the Legislative Decree 196/2003 Italian Republic, that follows and for clarity has been integrally copied herewith:

Article 7- Rights to access personal information as well as other rights.

1. The interested party has the right to obtain confirmation of the existence or not of personal information that regards him, even if they have not yet been saved, and the communication must be in an intelligible format.

The interested party has the right to obtain indication of:
The origin of personal information;
There final use and methods of treatment;
The logic applied in the case of treatment carried out with the use of electronic instruments;
Identification of person mandated to handle treatment, the persons responsible and the representative designated as per article 5, comma 2;
Of the subjects or categories of subjects to which the personal information can be communicated or can become aware whilst being the territorial representative.

3. The interested party has the right to obtain:

An update, change or rather, if of interest, an integration of information;
The cancellation, transformation in anonymous form or the blockage of information that is treated in violation of the law, inclusive of those that do not need to be archived in relation to the purpose for which they were gathered and later treated;
Certification that the operations at the aforementioned letters a) and b) are brought to the attention, even regarding their content, to those to whom the data is communicated or diffused, with exception of the case in which such undertaking is impossible or gives way to the use of means which are not proportionate with respect to the rights protected.

4. The interest party has the right to partially or totally refuse:

For legitimate reasons the treatment of personal data that regards him, even pertinent to the purpose of data collection;
The treatment of personal information that regards him for the sending of publicity materials or direct sales or the execution of market research or commercial notifications.

7. OBLIGATION OF 3C SYSTEM FOR DATA SECURITY

3C System uses maximum diligence and accuracy as well as all the technical guarantees to preserve the integrity and safety of the users’ personal information. However, we cannot insure or guarantee the safety of information that is transmitted to us and used by the buySecure® system which takes place at the risk and danger of the user. The use of non-protected WIFI or other networks that are not protected to send messages through the buySecure® system is never advisable. Once the transmission of information is received, 3C System shall carry out all that is necessary to guarantee the security of its systems. However we make note that the present does not constitute guarantee that there is no access to such information, nor that they can be disclosed, modified or destroyed in consequence of the violation of any of the safety measures adopted, physical, technical or managerial. If 3C System should become aware of a violation of its safety systems, it will try to send the user an electronic notice in such a way to adopt the necessary protective measures. In the case of safety violations, 3C System can also publish the relevant notices in the website www.3csystem.com or through the buySecure® service.
8. SPECIAL NOTICE FOR INTERNATIONAL USERS
The buySecure® service is managed in Italy. It is noted that the user must access the buySecure® service from a country that is outside the European Union that disposes of laws and regulations disciplining the gathering, using and disclosure of personal information that differs from Italian laws, it is opportune to note that through the continuous use of the buysecure® service, regulated by Italian law, that personal information is being transferred in Italy. In this case the user expressly gives permission to such transfer, giving his consent to the treatment of personal information as per Italian law in force on the subject.
9. MERGERS, SALE OR BANKRUPTCY
In the case that 3C System is incorporated or is merged with a third party company, it shall reserve the right to transfer or assign all the information that was gathered from users as a consequence of such merger, acquisition, sale or other modification of corporate control. In the case of bankruptcy, insolvency, reorganization, controlled administration or the transfer of assets to creditors, or in consequence of the application of laws or principles that have effect on the rights of creditors in general, 3C System could not be capable of controlling the methods with which personal information is treated, transferred or used.
